Payment terms

A 50% deposit is required to begin production with the balance due on completion prior to delivery. ScoolTunes.com™ accepts cash, check, money order, VISA, MasterCard, and American Express. Payment terms are negotiable for ongoing clients with $10,000.00+ annual sales on approved credit. Delivery of your materials for production indicates that you understand and accept the price and terms stated in your written price quote or as detailed in the current ScoolTunes.com™ Web site. Client agrees that if purchase is made with a credit card, their signature on the IPR Form represents the same agreement and obligation as signing a credit card sales slip in person.
All prices are subject to:
1) Industry standard +/- 10% fill deviation
2) Applicable tax
3) Applicable shipping
4) Artwork corrections as needed

Product unclaimed after 30 days from invoice date will incur interest of 1% per month accruing daily. Products unclaimed after 90 days of invoice date is subject to sell, disposal, recycle, destruction of materials at ScoolTunes.com™ discretion with no liability by to the customer. Customer agrees to be responsible for any and all costs, fees, charges or expenses - including any reasonable legal fees, collection fees, attorney and litigation fees) associated with any amounts owed to ScoolTunes.com™ by the Customer.

Warranty of product, limitation of liability

ScoolTunes.com™ affirms that all delivered products meet specifications as detailed in customer’s written price quote or current ScoolTunes.com™ Web
site, and meet accepted industry standards. ScoolTunes.com™ will, at their discretion, replace or refund any product deemed defective or incorrect that is not a result of issues related to the customer’s supplied materials. ScoolTunes.com™is not responsible for any loss of revenue, expenses, or damages of any kind that might have been incurred by the customer as a result of the product manufactured by ScoolTunes.com™. Any liability by ScoolTunes.com™is limited to only the replacement or refund of the project in question and not to exceed the agreed amount in customer’s written price quote or as detailed in the current ScoolTunes.com™ Web site.

Delivery - Turn time

All estimated turn times before materials are received are estimates only. Actual time may vary due to readiness of customer-supplied materials and other circumstances. Agreed pricing is not subject to change based on completion date of order. ScoolTunes.com™is not responsible for any delays, damage, or losses caused by third party delivery or freight companies. Client understands that they are responsible for any expedited shipping expenses requested to meet a particular deadline.

Materials

ScoolTunes.com™ assumes that the client has backup copies of all audio and electronic file contents and that materials issued to ScoolTunes.com™ are for the sole purpose of executing production of a project and are not required to be returned. ScoolTunes.com™ will treat all materials with professional care; however cannot be liable for damage or loss due to fire, casualty, negligence, or any other circumstance while materials are in the possession of ScoolTunes.com™. Customer's materials warehoused in ScoolTunes.com™ facilities or vendor partner facilities are not insured and are stored at customer's risk.

Client agrees to allow ScoolTunes.com™ to use the finished product as samples or for promotional purposes. Client will not be billed for any product kept by ScoolTunes.com™ to use as samples.

Order Cancellation

ScoolTunes.com™ reserves the right to refuse or cancel any order. Orders canceled at any time by customer will be subject to any expenses incurred by ScoolTunes.com™ prior to cancellation of the order at the agreed pricing in customer’s written price quote or as detailed on the current ScoolTunes.com™ Web site.

Intellectual Property Rights

Customer affirms that all information provided on the Intellectual Property Rights document is true and that all disc contents indicated as being "licensed" are properly licensed for replication under the terms of the original rights holder(s) with proof of such licensing and/or trademark authorization provided to ScoolTunes.com™. Customer affirms that they are the intellectual property rights owner for all contents indicated as being "owned". Customer affirms that they have applied for and paid any applicable mechanical licensing fees for all “cover” versions of selections included on my disc to The Harry Fox Agency or other applicable agency. Customer agrees to indemnify and hold harmless ScoolTunes.com™ against all claims, suits, liability and expense on account of alleged infringement of any patent, copyright or trademark, resulting from or arising in connection with the manufacture, sale, normal use or other normal disposition of any article or material furnished hereunder or with the performance of any service provided hereunder. Customer agrees to abide by the current version of the Anti-Piracy Compliance Program procedures and standards of the International Recording Media Association (available at www.recordingmedia.org).

ScoolTunes.com™. reserves the right to refuse the processing of any order not complying with the Anti-Piracy Compliance Program guidelines.
ScoolTunes.com™ reserves the right to investigate the ownership of any and all materials provided for manufacturing. If ScoolTunes.com™determines that customer is not the owner of material or does not have proper licenses, ScoolTunes.com™has no further obligation to provide products or service to client. Client agrees to pay ScoolTunes.com™ at the agreed quoted prices for any expenses that might have incurred prior to determination of customer’s lack of ownership or licensing.

File sharing is not illegal as long as you obey and comply with all relevant copyright laws.
